TMBS offers marketing, branding, design, consulting, coaching, and digital product services.
All services are customized to meet each client’s needs as outlined in individual proposals, contracts, or invoices.

TMBS reserves the right to update or modify available services at any time without notice.

All creative materials, strategies, designs, copy, templates, and resources produced by Tailored Marketing & Business Solutions (TMBS) remain the intellectual property of TMBS unless otherwise stated in writing.

We take great pride in the originality and integrity of our work.
To protect both parties, the following terms apply:

1. Ownership of Custom Work

​

Upon full payment, clients receive ownership of the final approved deliverables - such as logos, websites, marketing materials, and brand assets - created specifically for their business.
TMBS retains ownership of all preliminary concepts, drafts, and working files not selected for final use.

2. Strategic Marketing & Framework 

​

All proprietary processes, marketing strategies, content frameworks, systems, or coaching materials developed by TMBS remain the intellectual property of TMBS.

Clients receive a non-exclusive, non-transferable license to use these materials internally for their business operations and marketing activities, but not to reproduce, resell, or share them externally.

3. Digital Products & Templates

​

Digital downloads, courses, or templates purchased from TMBS (including Canva templates, social media kits, or design resources) are licensed for personal or business use only.

They may not be copied, resold, shared, or redistributed in any form, whether digitally or in print.

4. Portfolio Use

​

TMBS reserves the right to showcase completed projects, designs, and case studies as part of our portfolio, social media, or promotional materials - unless the client requests otherwise in writing before project completion.

5. Copyright Production

​

All materials created by TMBS are protected under U.S. and international copyright laws.
Unauthorized reproduction, modification, or distribution of TMBS content, templates, or strategies may result in legal action.

Payment terms for services and products are outlined in each proposal, invoice, or checkout page.

• All invoices are due as stated (typically upon receipt or per milestone schedule).

• Late payments may result in paused work or additional fees.

• Digital product purchases are processed through secure third-party payment platforms such as PayPal, Stripe, Square, and others.

Because our work is customized, most services are non-refundable once work has begun.  Each project requires time, research, and strategic development from the start, which represents a significant portion of the overall service value.

A non-refundable deposit may be required to reserve your project on our calendar.  This deposit covers administrative setup, initial planning, and early creative work to ensure your project moves forward efficiently.

If a client chooses to cancel or postpone a project after work has begun, payments made up to that point are considered non-refundable, as they reflect work already performed and time reserved specifically for your project.

However, TMBS may consider partial refunds or future credits on a case-by-case basis for unused time or uncompleted deliverables when cancellation occurs before major milestones are completed.

Digital downloads, templates, and online materials are non-refundable once delivered or accessed.
If you experience a technical issue or cannot access your digital files, please contact us within seven (7) days, and we will make every effort to resolve the issue promptly.

By engaging Tailored Marketing & Business Solutions (TMBS), you agree to act as an active and responsive partner in the creative process. Your collaboration and timely communication are essential to keeping your project on schedule and achieving the best results.

Clients agree to:

• Provide accurate and complete information about your business, goals, and project needs.

• Supply necessary content, credentials, and access, including admin logins, digital platform permissions, and correct account credentials, when requested, to avoid project delays.

• Submit only original or properly licensed materials (including text, images, videos, logos, fonts, and design assets).  TMBS is not responsible for copyright violations or third-party claims resulting from unauthorized or unlicensed content provided by the client.

• Deliver all images, logos, and brand assets in high-resolution formats suitable for digital or print use. If only low-resolution materials are available, TMBS may recommend re-creation or professional design work at an additional cost to ensure quality results.

• Review and approve deliverables in a timely manner, providing clear feedback to keep the project moving forward.

• Respect agreed timelines and communication boundaries, understanding that responsiveness directly impacts scheduling and deadlines.

Delays in providing requested materials, approvals, or access may result in timeline extensions, rescheduling, or additional fees if significant project time has been reserved or lost due to inactivity.

TMBS cannot be held responsible for missed deadlines, publishing delays, or project disruptions caused by incomplete, inaccurate, or delayed client submissions.

Our website, templates, and services are provided on an “as-is” and “as-available” basis.
TMBS makes no guarantees that use of this site or materials will result in specific business outcomes, performance increases, or revenue growth.

We provide guidance and creative tools, but success ultimately depends on your implementation and external factors beyond our control.

To the fullest extent permitted by law, TMBS, its owners, and affiliates are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our website, services, or materials.

Total liability is limited to the amount paid for the specific service or product in question.

Our website may include links or integrations with third-party platforms (e.g., Wix, Canva, Zapier, Mailchimp, PayPal, etc.).

TMBS is not responsible for the content, policies, or performance of these external sites or tools.

TMBS respects all confidential information shared by clients.

Project materials, business details, and proprietary data will not be shared outside of necessary service execution unless required by law or with written consent.

Either party may terminate a project or contract in writing.

In the event of termination, the client is responsible for payment of all completed work and approved deliverables up to the termination date.

These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law provisions.

We may update these Terms occasionally to reflect operational or legal changes.
The revised version will be posted here with a new effective date. Continued use of our website or services signifies acceptance of the updated Terms.
